1. Acceptance of Terms

By creating an account or using Catberry, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our platform.

2. Account Requirements

To use Catberry, you must:

• Be at least 13 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

3. Service Description

Catberry is a community platform for discovering and connecting with live music events, artists, bands, venues, and organizations. Our services include browsing concerts and jam sessions; joining circles; supporting organizers with payments and paid memberships; and managing event listings and profiles.

4. Payments and Payouts

Catberry lets you support organizers with one-time payments and paid circle memberships, and lets bands, organizations, and people receive those payments. Stripe processes every payment and holds all funds. Your card and bank details go to Stripe directly, and Catberry never sees or stores them.

Catberry deducts a platform fee from each payment before the remaining balance reaches the recipient.

To receive payouts, you must set up a payout account with Stripe and complete Stripe's onboarding. We only send payouts to a connected Stripe account.

We send payouts automatically on our schedule. We pay out once your available balance reaches $100, or every 3 months if you have a balance waiting, whichever comes first. If you're earning quickly, we pay out at most once every 7 days.

We may change the platform fee or the payout schedule from time to time. Changes will be posted on this page with a revised "Last Updated" date.

You are responsible for any taxes on money you receive through Catberry.

5. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Post false, misleading, or harmful content
• Attempt to gain unauthorized access to any part of the platform
• Use the platform for any illegal or unauthorized purpose

6. Intellectual Property

All content on Catberry, including text, graphics, logos, and software, is the property of Guided Rails LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. User Content

You retain ownership of content you submit to Catberry. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services.

You don't need an account to submit some content, such as starting a band page. The same terms apply. You keep ownership of what you submit and grant us the license above. Content submitted without an account stays internal, visible only to our team, until someone here reviews it, and we may edit or remove it at our discretion. If you never create an account, email us to ask about or remove that content.

8. Disclaimer of Warranties

Catberry is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Guided Rails LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Catberry.

10. Termination

We may terminate or suspend your account at any time for violations of these Terms of Service. You may also delete your account at any time. Upon termination, your right to use the platform will immediately cease.

11. Governing Law

These Terms of Service shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal proceedings shall occur in Wake County, North Carolina.

12. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of Catberry after changes constitutes acceptance of the new terms.
